A Mediation Advocate requires very different skills from a litigation advocate. These skills include:
Being an effective negotiator
The ability to explore non-legal issues, such as commercial and personal interests
The ability to do risk analysis [BATNA’s] in respect of both sides of the dispute
The ability to manage client’s emotional responses to settlement negotiations
A Mediation Advocate should be briefed to:
Develop a mediation and settlement strategy
Formulate and evaluate settlement options
Do risk assessments on both sides of the dispute
Prepare the client for mediation proceedings
Represent the case in mediation proceedings
Our view is that Mediation Advocates in Legal Mediation should:
Be legally qualified
Have experience of legal practice
Be qualified and accredited as a commercial mediator
Have experience of mediating litigated cases
Our Mediators charge competitive professional fees.
Daily rates range from R18 000 to R26 000 (depending on the nature of the engagement). All our fees are quoted upfront, and you will know the full cost of the engagement before you decide to appoint one of our mediators.
